How do I check whether an HOA allows a home to be rented?

Read the association's recorded governing documents, especially the declaration (or condominium declaration) and any amendments, then confirm the current rules in writing with the association or its manager. Those documents, not a listing description or a verbal answer, control whether a home can be rented, for how long, and whether approval is required.
The nuance is that rental rules can change. An association may amend its documents, and a restriction can apply to minimum lease length, how many times you can rent per year, a waiting period after you buy, a cap on the number of rentals, or short-term rentals specifically. Check the current, complete set of documents, not just the version in the seller's file.
Why it comes up in Florida
Florida has a very large inventory of condominiums, townhomes, villas and master-planned HOA communities. Many of them are governed by associations that may require buyer or tenant approval and estoppel certificates, so the right to rent is part of due diligence, not an afterthought.
For an investor, a rental restriction can decide whether a property works at all. A home that cannot be leased, or cannot be leased the way your plan assumes, is a different purchase. Short-term and vacation rentals add another layer, since local ordinances can regulate registration and licensing in addition to what the association allows.
Timing matters too. Purchase contracts often have an inspection period, and association document delivery and approval processes run alongside it. Reviewing rental rules early, before that period ends, gives you the most room to decide.
What you can check yourself
Request the full association documents
Ask the seller or listing agent for the declaration, bylaws, rules and regulations, amendments and budget. Association documents are a normal part of due diligence on any HOA or condo purchase.
Search the recorded documents
The declaration and its amendments are typically recorded with the county. Your county clerk or official records search can show whether recorded amendments changed the rental rules.
Ask the association in writing
Email the association or its management company and ask about leasing minimums, caps, waiting periods, application or approval steps, and short-term rental rules. Keep the written reply.
Review the estoppel certificate
An estoppel certificate from the association can show account status and related information at closing. Ask what it covers, since tenant approval requirements usually come from the governing documents.
Check local short-term rental rules
If you plan vacation or short-term rentals, verify county and city registration and tax requirements separately. Your county or city and the Florida DBPR are places to start.
When to bring in a licensed professional
Call us if the documents are unclear, conflict with each other, or the association's answer does not match what you read. We can help you request the right documents, line up the review with your inspection period, and compare the rental rules against your plan. A licensed real-estate professional, either Premier Real Estate Group Inc or a licensed agent we refer you to, will contact you by phone or email.
We are a brokerage, not a law firm. If you need an interpretation of an amendment, a dispute with the association, or a question about enforceability, a Florida real-estate attorney should review the documents. The documents and the contract control, so get legal advice before you rely on a reading of them.

Related questions
- Can an HOA change its rental rules after I buy?
- Associations can sometimes amend their governing documents under the procedures those documents set out. How and whether a change applies to you depends on the documents, so ask an attorney if you are worried about an amendment.
- Does the association have to approve my tenant?
- Some associations require tenant approval or an application, and others do not. Read the declaration and rules, and confirm the process in writing with the association before you sign a lease.
- Does a condo's milestone inspection affect renting?
- It does not set rental rules, but it can affect your costs. Florida requires a milestone inspection for condo buildings three stories or taller once they reach 30 years (s. 553.899, F.S.), and a structural integrity reserve study (s. 718.112(2)(g), F.S.). Ask for those reports, because they can lead to special assessments.
